German term

Persönlichkeitsrechte

German to English Bus/Financial Law (general)
Hello again,

More from the marketing research document:

"Trotzdem haben in den meisten Ländern auch die Verbände der Marketing Researchsinstitute Regeln für den angemessenen Umgang mit den Persönlichkeitsrechten der Teilnehmerinnen und Teilnehmer ans solchen Studien verabschiedet."

My question is - is this simply "personal rights"? I have (just about) rejected the Wikipedia translations "personality rights" and "publicity rights" as these seem too narrow. The client has provided the following -
"es geht um Datenschutz und Anonymität und darum, dass durch Marktforschung niemandem ein Schaden zugefügt werden soll."

Would "personal rights" be appropriate here? Privacy rights? Rights to privacy?

Thanks a lot!

Hilary.

Discussion

Hilary Davies Shelby (asker) Feb 24, 2008:
This is the feedback I got from the client (author) on this one - "es geht um Datenschutz und Anonymität und darum, dass durch Marktforschung niemandem ein Schaden zugefügt werden soll." The client (author) suggested "personal rights", but didn't really know either. I ended up translating it as "individual rights", with a note to the effect that this was the most all-encompassing suggestion I'd received! Thanks very much for all your help on this - much appreciated, as always!
Hilary Davies Shelby (asker) Dec 10, 2007:
Well, the previous chapter did include a reference to Nazi doctors, so it's not that far-fetched!!!
Francis Lee (X) Dec 10, 2007:
Certainly an interesting point raised by Armorel re. "ethical standards" - although she may be being a bit rash to simply dismiss references to "privacy". Either way, a solution including "experiments conducted" is probably a bit OTT!
Hilary Davies Shelby (asker) Dec 10, 2007:
Right to be informed of experiments conducted on oneself? Right to volunteer as a guineapig (or to refuse to do so)?
Hilary Davies Shelby (asker) Dec 10, 2007:
Armorel is exactly right - I hadn't realised it before, but this DOES tie in with a previous section on the ethics of research and of treating people as unwitting guineapigs. This makes it extremely broad - heading towards individual/personal rights?

individual rights

I think, in this context we have to go for the more comprehensive term, including all the suggested ones.

neutral Francis Lee (X) : incl. right of assembly, freedom of speech etc.?

2 KudoZ points awarded for this answer. Comment: "I'm still not sure about this one - will post the client feedback in the Notes section - but this is what I went with in the end, as it seemed the "broadest". Thanks very much for all your help!"

data protection rights

Here's another possibility: data protection rights

Peer comment(s):

agree BrigitteHilgner : This is actually the term generally used in market research (I should know - I've been involved in that business for nearly 30 years).

Just as I suspected... Thanks for that confirmation, Brigitte! ;-)

(rights of/to) privacy

"privacy" is certainly the keyword here IMO.

This seems to be a little narrow than just personal rights.

ethical standards

The definition provided by your client is broad, and everyone who has suggested terms relating to privacy and data protection has overlooked the fact that these Persönlichkeitsrechte also include "dass durch Marktforschung niemandem ein Schaden zugefügt werden soll" - which would come under the heading of ethics in English - so I wonder if you want to consider working this term in somewhere.
Note from asker:
Armorel, you are exactly right about the wider implications of the term - I hadn't realised it before, but it DOES tie-in with a previous section on ethics and using humans as uninformed guineapigs.
Peer comment(s):

neutral Paul Cohen : I think this idea is already included in the notion of "data protection rights," which were introduced to protect individuals from being harmed by unscrupulous (and unethical) entrepreneurs and companies (including senders of SPAM, *sigh*).

No, I mean ethics (and "Schaden") in the much wider sense (as used in psychology etc.) that what is done with people shouldn't be physically or emotionally distressing or harmful - nothing at all to do with data protection
agree Bernhard Sulzer : I agree with the term - it's more than/different from legal protection; this is ethical conduct that should be applied to any individual anywhere.

(all applicable) protective rights due to any individual

or:

according to the ethics of social conduct
according to the ethical code of conduct
according to the rights of the (an) individual

It definitely goes in the direction Armorel is suggesting.
These are rights not guaranteed by any government but rules/ethics of social conduct/moral rights. I think rights of the individual comes very close as well. So my suggestion is somewhat following Armorel's and Tilman's.

how about:

However (nevertheless), the associations of market research institutes have adopted rules (provisions) to make sure all participants are treated according to the protective rights due to any individual

No one can read these two great opinions, and the opinions in the Pacific Ry. Comm. Case, from which the foregoing quotation is made, without perceiving how closely allied in principle are the three protective rights of the individual-that against compulsory self- accusation, that against unlawful searches and seizures, and that against unlawful inquisitorial investigations.
