Madde 16-Yakalanan kiþi, gözaltýna alýnmasýný gerektirecek bir nedenin tespit edilememesi veya yakalama sebebinin ortadan kalkmasý halinde kolluk kuvvetince derhal salýverilir.
Yakalanan kiþi, hakkýnda ýslah veya tedavi tedbiri alýnmasý gereken kiþilerden ise ilgili kuruma teslim edilir.
Gözaltý süreleri azami süreler olup gözaltýna alýnan kiþilerin iþlemlerinin en kýsa sürede bitirilmesi esastýr.
Gözaltýna alýnanlar, iþlemleri bitirildikten sonra gözaltý süresinin dolmasý beklenmeden kolluk kuvvetince ilgili Cumhuriyet savcýlýðýna derhal sevk edilir.
Gözaltý süresi içerisinde ve nihayet süre sonunda, gözaltý sebebinin ortadan kalkmasý veya kiþi hakkýnda delil elde edilememesi hallerinde durum derhal yetkili Cumhuriyet savcýsýna bildirilir, tutuklama iþlemine giriþilmediðinde kiþi hemen salýverilir.
Yakalama iþlemine veya gözaltý süresinin uzatýlmasýna iliþkin Cumhuriyet savcýsýnýn emrine karþý hakime yapýlan baþvuru üzerine verilen serbest býrakma kararý derhal uygulanýr.
Emanete alýnan þahsi eþya, para eksiksiz olarak adý geçene teslim edilerek ve giriþte tanzim edilen üst veya vücut aramasý tutanaðýna þerh düþülerek kendisine imzalatýlýr.
Sevk veya serbest býrakma iþlemi ve sebebi, Yönetmeliðin eki “Sevk/Serbest Býrakma Tutanaðý”na (Ek-C ) baðlanýr, bunun bir sureti gözaltýndan çýkarýlan kiþiye verilir.
Translation - Turkish Referral to Competent Authorities or Release
Article 16-The apprehended person is immediately released by police forces if a reason for his holding cannot be identified or the rationale for his apprehension is no longer valid.
If a correction or treatment measure is required, the person apprehended is taken and handed over to the relevant institution.
Holding periods are maximum and completing the proceedings pertaining to detainees within the shortest extent possible forms the basis.
After necessary proceedings are completed detainees are immediately referred to the Office of Public Prosecutor by police forces before the termination of holding period.
Should the rationale of holding no longer exists or no evidence be gathered against the detainee during and finally upon the completion of holding period, authorized public prosecutor is immediately informed thereof and the detainee is released when there is no attempt for arrest.
Decision to release which is taken upon application to the authorized judge against the order of public prosecutor for apprehension or extension of holding period is applied immediately.
Personal belongings and money in safekeeping is handed over to the person fully and an explanation is added to the body search minutes which has been issued at the time of his\her admission and the minutes is undersigned by the person himself\herself.
The act of referral or release and the rationale thereof is recorded in Referral\Release Minutes(Appendix-C) enclosed herewith and a copy of it is provided to the person who is no longer a detainee.
