PRAVA I OBAVEZE ZAPOSLENOG I POSLODAVCA
Član 2.
Zaposleni ima pravo na poštovanje dostojanstva ličnosti, zaštitu od diskriminacije i zlostavljanja na radu, kao i pravo na druge oblike zaštite u skladu sa Zakonom i ovim Pravilnikom, pravo na odgovarajuću zaradu, bezbednost i zdravlje na radu, zdravstvenu zaštitu, zaštitu ličnog integriteta, dostojanstvo ličnosti i druga prava u slučaju bolesti, smanjenja ili gubitka radne sposobnosti i starosti, materijalno obezbeđenje za vreme privremene nezaposlenosti, pravo na sindikalno organizovanje i druga kolektivna prava u skladu sa Zakonom i opštim aktom, odnosno ugovorom o radu.
Zaposlena žena ima pravo na posebnu zaštitu za vreme trudnoće i porođaja. Zaposleni ima pravo na posebnu zaštitu radi nege deteta, u skladu sa Zakonom. Zaposleni mlađi od 18 godina života i zaposlena osoba sa invaliditetom imaju pravo na posebnu zaštitu, u skladu sa Zakonom.
Zaposleni je dužan da savesno obavlja poslove na kojima radi, da poštuje organizaciju rada i poslovanja Poslodavca kao i uslove i pravila Poslodavca u vezi sa ispunjavanjem ugovornih i drugih obaveza iz radnog odnosa, da obavesti Poslodavca o bitnim okolnostima koje utiču ili bi mogle da utiču na obavljanje poslova utvrđenih ugovorom o radu, da obavesti Poslodavca o svakoj vrsti potencijalne opasnosti za život i zdravlje i nastanak materijalne štete, da se obrazuje, stručno osposobljava i usavršava za rad kada zahteva potreba procesa rada (u skladu sa programom Poslodavca), kao i druge obaveze u skladu sa Zakonom i ovim Pravilnikom.
Poslodavac je dužan da obezbedi zaposlenom bezbedne uslove rada, zaradu i druga primanja, kao i druga prava u skladu sa Zakonom, drugim propisima i ovim Pravilnikom.
Na prava, obaveze i odgovornosti zaposlenih koji nisu uređeni ovim pravilnikom primenjuju se odgovarajuće odredbe Zakona i drugih važećih propisa.
Translation - Serbian RIGHTS AND OBLIGATIONS OF THE EMPLOYEE AND THE EMPLOYER
Article 2
The employee is entitled to the respect of their person’s dignity, protection from discrimination and abuse at work, as well as the right to other forms of protection in accordance with the Law and this Labor code, is entitled to adequate remuneration, health and safety at work, health care, protection of personal integrity, dignity of person and other rights in case of illness, reduction or loss of working capacity and old age, material security during a temporary unemployment, the right to associate in a union and other collective rights in accordance with the Law and the general regulations, i.e. the employment contract.
A female employee is entitled to special protection during pregnancy and the childbirth. The employee is entitled to special protection for the purpose of childcare, in accordance with the Law. Employees under the age of 18 and an employed persons with disabilities are entitled to special protection, in accordance with the Law.
The employees shall be obliged to diligently perform the tasks on which they are engaged, to respect the established work and business processes of the Employer as well as the conditions and rules of the Employer regarding the fulfillment of contractual and other obligations from the employment relationship, to inform the Employer about important circumstances that affect or could affect the performance of the tasks established by the Employment Contract, to inform the Employer of any kind of potential danger to life and health and the occurrence of material damage, to be educated, professionally trained and empowered for work when the work process requires it (in accordance with the Employer's program), as well as other obligations in accordance to the Law and this Labor code.
The employer is obliged to ensure safe working conditions for the employee, to provide earnings and other benefits, as well as other rights in accordance with the Law, other regulations, and this Labor code.
The rights, obligations and responsibilities of employees that are not regulated by this Labor code shall be subject to the relevant provisions of the Law and other applicable regulations.
