Double checking this cos I have overthought it!

XXX construira a su cargo y en beneficio del vendedor un pozo de agua junta la finca.

I am proofing a translated docment and it is translated as xxx will build a well at the cost of and to the benefit of the seller.
However, I read it as xxx is responsible for the cost and the well is for the benefit of the seller.
But I am wondering if its ambiguous - could "su" potentially refer to the vendor? - But in that case I would have thought the construction would have been *al* cargo y en beneficio de...

This concerns a large property divided into two.
Proposed translations (English)
4 +1 xxx shall, at its (own) expense, build a well for the seller
4 xxx is responsible for the construction and the well is for the benefit of the seller.
4 XXX will take responsibility for building in benefit of the seller, a well attached to the property/
4 xxx shall build a well for the benefit of the seller assuming the costs for the same

I think this is clearer and more concise than the previous answers, and you don't need to say "for the benefit of".
You might want to add "own", though I think it's apparent from the word order that xxx is paying for it.

xxx is responsible for the construction and the well is for the benefit of the seller.

Other option: xxx is charged with the construction of the well for the benefit of the seller.

You're right, "su" is referring to the constructor and not to the seller. Otherwise, it would be al cargo y beneficio de..., as you propose.

However, I would stick to the original and say it's responsible for the construction, and not the cost, because I assume there are more aspects there than the mere cost of the construction.

In my perspective, the meaning looks like:

"XXX will take responsibility for building in benefit of the seller, a well attached to the property/estate."

Note: not a literal translation. I wrote as above to express my interpretation of the meaning.

xxx shall build a well [...] for the benefit of the seller assuming the costs for the same. In other words xxx assumes the costs for building the well.

If this is for a contract, it is preferable to use 'shall'.

"Su cargo" almost always implies assuming costs

If "su" would refer to the seller, it would say 'xxx construirá un pozo a cargo del vendedor"
