I think that what you have is a variation on the formulation in the following EU regulation:

See paragraph 2, section a: "any information relating to an identified or identifiable natural person ('data subject')"..."
In other words, it's not a question of choosing either "identified" or "identifiable"; the formulation needs to cover both.

: Even if it were correct to write "identified" alone, without "indentifiable," which it's not, using the definite article is incorrect here./Because it's a definition for the general case - ANY person who might be identified by ANY instance of such info.
