geschäftsähnliche Handlungen

German to English Law/Patents Law (general) power of attorney
Any ideas on how best to translate this term? I've checked out the meaning (http://de.wikipedia.org/wiki/Geschäftsähnliche_Handlung) but can't find a succinct English equivalent. It comes in the phrase "Die Vollmacht ermächtigt, mich in allen Vermögensangelegenheiten gerichtlich und außergerichtlich zu vertreten. Sie ist völlig unbeschränkt und umfaßt insbesondere aber nicht ausschließlich das Recht, .....geschäftsähnliche Handlungen wie z. B. Mahnungen, Fristsetzungen, Anträge, Mitteilungen vorzunehmen".

I'm not sure if this captures the German term precisely, but I think it's in the right direction. Based on the Wikipedia definition you supplied, the full term is "rechtsgeschäftsähnliche Handlung". A Rechtsgeschäft is a legal transaction or contract.

Eine geschäftsähnliche Handlung ist eine Erklärung, insbesondere Mitteilung oder Aufforderung, die kraft Gesetzes eine bestimmte Rechtsfolge herbeiführt. Die geschäftsähnliche Handlung ist zu unterscheiden von der Willenserklärung und dem Realakt. Der wesentliche Unterschied zur Willenserklärung besteht darin, dass bei der Willenserklärung die Rechtsfolge eintritt, weil sie vom Willen des Erklärenden maßgeblich bestimmt wird, während bei der rechtsgeschäftsähnlichen Handlung die Rechtsfolge unabhängig von dem Willen des Erklärenden gewissermaßen automatisch eintritt.

agree Jo Bennett : A copy of a completed EPA (now LPA) form in front of me just says "I ** appoint ** to be my attorney ... with general authority to act on my behalf in relation to all my property and affairs": but this doesn't seem specific enough to render the German.

Equally, it seems to me that "declarations" as suggested by fineynegoddess involve an expression of will, and it seems the key element of the "geschäftsähnliche Handlung" is that the legal consequences arise independently of the will of the individual (see Wikipedia article). I think Kim's proposed answer is on the right track,though I'm unsure as to whether it renders exactly the same legal concept. "

neutral Kim Metzger : A "trade-similar action"? The target language is English./"trade-similar" doesn't work in English as an adjective. We can't do the same thing with adjectives that can be done in German.

Ich würde hier diese Terminologie vorziehen, da das Wort transactions IMHO zumindest zwei Partner impliziert. Im Beispielsatz steht hingegen ausdrücklich, daß es sich bei geschäftsähnlichen Handlungen um einseitige Aktionen handelt wie z.B. Mahnungen, Anträge, und Fristsetzungen. Das BGB definiert sie ebenfalls in dieser Weise: Mahnungen, Aufforderung, Fristsetzung.
