Spanish term

proceso contencioso administrativo

Spanish to English Law/Patents Mining & Minerals / Gems Contratos legales
The document refers to mining properties and rights, the article of the contract says textually:

I hope someone with expertise in the legal field and contracts or legal agreements can help me.
Would appreciate it very much!

Discussion

Carlos Teran (asker) Aug 13, 2019:
@adrian Yes, this does refer to Bolivian Mining Laws.

@ Jane Very good, Jane. I - as an erstwhile UK admin. lawyer - had in fact waded through the plethora of entries and endeavo/u/red to distil the essence thereof, and then adapt to the question asked, albeit without any indication of a Lat./S. Am. ? country

4 KudoZ points awarded for this answer. Comment: "Gracias Enrique. Encaja perfectamente en el contexto del documento que estoy traduciendo. Aunque las referencias de los compañeros han sido muy buenas, también."

Spanish term (edited): actualmente en proceso contencioso administrativo

currently a contentious administrative /judicial review/ matter on appeal

as opposed to: on judicial review.

I suppose this is Bolivia, though no country is mentioned.

contencioso administrativo > related to an adminsitrative dispute /West/

Sub judice/iudice on appeal

Judicial review is a bit problematic because . 1. there is the 'amparo' constiutional procedure in Lat. Am. > the late ProZ translator Henry Hinds: 'do not tranbslate' and 2. judicial review against a public Body in the UK can only review the merits of a decision and determine whether it is within the intra vires / power of the Body and recommend action. It is not an Appeal as such and cannot set aisde e.g. a Mining Ministry's decision,
Peer comment(s):

neutral philgoddard : It doesn't say anything about appeal or judicial review as far as I can see. It just says litigation.

'...confirmada por el Ministerio de Minería en *Recurso Jerárquico* West: appeal to the head of an agency > Ministry y actualmente se encuentran en proceso...' the Appeal is still going through the Courts.

litigation

This can be expressed much more concisely in English: "currently the subject of litigation".

Enrique is partially right (contentious simply means disputed), but "administrativo" is a false friend. In this context, it simply means "against the administration", ie the ministry of mines. You don't need to say "administrative", as it goes without saying. You might want to put in a translator's note explaining why you've omitted it.
