Spanish term

proceso causante de la demanda

Can´t seem to Word this right. It seems" proceso causante de la demanda" is something like "originator action of the claim" , but that just does not sound like natural English or it just sounds clumsy.

events underlying the (present) complaint; the basis of the (present) complaint

It would be a strain to translate "proceso" literally here, because it does not refer to a formal process as such (admittedly a demotion is a formal process, but that is not the essence of the present sentence).
2nd alternative: the demotion underlying the (present) complaint.
3rd alternative: the demotion which gave rise to the (present) complaint.

4th alternative (to be closer to "proceso"): the sequence of events underlying the (present) complaint.
(Note: The word "events" in the first alternative may be plural only as a conceit. The "events" is (are) synonymous with the demotion.

neutral TechLawDC : I think the emphasis is on "causante" here. The author is not referring to a preliminary (or initial) procedural step in perfecting the complaint.

agree Adrian MM. (X) : (E&W) the originating process of the (employment tribunal) complaint vs. county court claim NB might not work in US & Scots law http://www.proz.com/kudoz/italian_to_english/law_general/574... > I repeat: NOT in the US

Yes, but let us forget USA/E&W/Scotland/Canada/Isle of Man et al here, and use something comprehensible everywhere

neutral Billh : dreadful English. process originating or giving rise to the claim. 1 it is not that sort of process- 2 process for the claim is a grammatical nonsense

Civil Procedure Act 2005, S.3 "originating process" means the process by which proceedings are commenced, and includes the process by which a cross-claim is made" ; you'd better complain to the Parliamentary Counsel who draft this kind of legislation

neutral AllegroTrans : how does "literal" work for dense legal terminology? My experience is that it hardly ever does
