Not sure whether "the existence of" adds anything meaningful here.

(shall mean neither) the existence of any labo/u/r or employment /BrE: control-tested/ relationship

Previously in the UK the employer-employee relationship used to be known as a master-servant relationship.

Latterly, the 'right of control test' has applied to determine such a status.
