Portuguese term
Justificação de ausência para declaração de morte presumida
Portuguese to English
Law/Patents
Law (general)
Court documents
In the following context:
Acção especial de Justificação de ausência para declaração de morte presumida
I'm ok with the special proceedings and declaration of presumptive death, but I'm at sea re: the justificação de ausência...
This a court document with the following parts: a report with a petition to have the presumptive death declared, the Grounds, with motives, grounds and court reasoning; Legal grounds justifying the decision; and the court decision, declaring the presumptive death.
Any takers? I'm translating this for information, not legal purposes, but I'd like to provide as close to an English equivalent as I can. Thank you muchly!!!

Death in absentia or presumption of death
I read your heading as a long-winded version of:
DIREITO [COM]
PT ausência declarada
EN presumption of death
From IATE
I believe the English equivalent is just this shortened version:
http://en.wikipedia.org/wiki/Presumption_of_death
Death in absentia (or presumption of death) is a legal declaration that a person is deceased in the absence of remains (e.g., a corpse or skeleton) attributable to that person. Such a declaration is typically made when a person has been missing for an extended period of time without any evidence that the person is still alive, or when the circumstances surrounding a person's disappearance overwhelmingly support the belief that the person has died (e.g., an airplane crash).
My two cents :)

Note from asker:
I'm still at sea re: "justificação de ausência" - it seems to be an official document title. Presumption of death I have, but I think this is more than that. Neckonote, sorry, I didn't understand your second sentence... insert what? Sorry I may need more coffee... :) |
