This is taken from the conclusions submitted by the petitioner in a divorce case.
Is anyone able to clarify the process described below? I was under the impression that the plaidoiries were the same as the debats, and so I am confused as to the stages that have taken place and have yet to take place in this case:
ATTENDU QUE Madame L a fait assigner en divorce son époux sur le fondement de l’altération définitive du lien matrimonial depuis plus de 2 ans tels que fondée sur l’article 237 du Code Civil ;
QUE Monsieur L n’a pas constitué avocat ;
QUE pour autant l’affaire fixée à plaider, a fait l’objet d’une réouverture des débats pour pouvoir justifier, pièces à l’appui de la réalité de la séparation effective entre les parties depuis plus de deux au sens légal du terme ;
The rest of the document then goes on to provide the required evidence of the separation.
