Fideicomisso é o ato em que o testador (fideicomitente) impõe a um herdeiro (fiduciário) a obrigação de depois da sua morte, a certo tempo ou sob certa condição, transmitir a outro e último destinatário (fideicomissário) sua herança ou legado.

Ou seja, a procuração continuará a ter efeito mesmo após os fiduciários (trustees) terem entregue o patrimônio do fideicomisso (trust corpus) ao fideicomissário (herdeiro final, para quem o fideicomisso foi estabelecido).
