After due hearing had, the Court finds that no person entitled to notice of said hearing who has not signed and filed in court a written appearance and wait of notice or was not represented by an attorney duly apponited is in the military service of the United States or an allied nation..

frase precedente "The Court finds that worn return has been made that notice of the time and place set for the said hearing has been given as directed on said order, which return the Court finds to be true and accepts.
Quindi la corte ha ricevuto la relata e ne appura la veridicità.

non potrebbe essere "non ha presentato dichiarazione giurata nè è in attesa di notifica.."

Non il mio campo, ma secondo me ci potrebbe essere un errore ortografico ("wait" anziché "want")

agree Oscar Romagnone : Penso anch'io che vi sia stato qualche errore di battitura e in particolare che il termine in questione sia "want of notice", da tradursi preferibilmente con "mancata notifica (della nomina di un difensore)"; notifica che il convenuto deve dare all'attore

A mio parere, si tratta di un refuso per "writ of notice" (erre invece di a);
in tal caso avrebbe senso :-)

The defendant may make default in two ways : either by failing to give notice of retainer of a solicitor — default attributable to the party, default through want of appearance **or want of notice of appointment of solicitor** — or by failing to plead after having given notice of retainer of one, — default attributable to the solicitor, or default through want of pleading i).
