Danish term

valgfrihed

Danish to English Law/Patents Real Estate Security Pledge Statement
Hi - I was hoping to find some clarification regarding the following. It looks like "the bank is free to choose how to utilize the pledge in relation to the debtor's total exposure". Am I missing anything? Thanks for your help!

[banken] har ingen pligt til forlods at søge dækning i det stillede pant, ligesom [banken] har valgfrihed med hensyn til anvendelsen i forhold til debitors samlede engagement

freedom of choice| BrE> at liberty; right of election

valgfrihet> option, Bailey.

First things first, I'm unsure if, in the USA, a real estate mortgage / lien would be labelled a pledge. Cut to Rod Steiger's legendary movie of the 'Pawnbroker'.

[banken] har ingen pligt til forlods at søge dækning i det stillede pant, ligesom [banken] har valgfrihed med hensyn til anvendelsen i forhold til debitors samlede engagement :

[the bank] is under no duty in advance/ not pre-required/ to seek cover out of the collateral security posted (BrE: put up or furnished), besides which [the bank] is *at liberty* with regard to the way it (US: the property lien; UK: land charge -> lien is used for goods, co. shares and motor cars classifiable for US tax purposes ? as 'personal real estate') is used in relation to the borrower's (US: lienor's / UK: chargor's) aggregate exposure.
Example sentence:

A property lien is a legal claim on assets that allows the holder to obtain access to the property if debts are not paid.

Free to choose

As a Danish native, I will say that your translation of "Valgfrihed" > "free to choose" is the most correct form you can use. It's rather the choice of the term "valgfrihed" in the Danish text, there's a little off in this context. Normally we would write "frit valg".
