French term

récapituler en capital

French to English Law/Patents Law (general)
Case about damages due to accident involving bodily injuries.

A calculation error in a previous judgment is being rectified here.

"« Déboute AAA du surplus de ses demandes ; »
Par requête en date du 23 novembre 2022, la société BBB demande la rectification du jugement qui serait entaché d'une erreur matérielle en ce que :
-le tableau récapitulatif des divers postes de préjudice en page 22 et 23 de la décision, en ce que la partie du préjudice d'assistance par une tierce à titre temporaire allouée sous forme de rente est en outre récapitulée en capital (pour la somme totale de 000 000,72 €) en sus de la rente ensuite rappelée ;
-la même erreur se reproduit au dispositif et conduit à faire supporter deux fois le même poste de préjudice sous forme de rente et de capital ;
...

AAA is one of the victims. BBB is one of the insurance companies.

There's a lot of talk of "en capital" in this document. My assumption is that it mainly means "as a capital value", more particularly when used in combination with "rente", so a capital sum sufficient to produce a "(regular) income" for however long (sometimes viagère ).

I think it might just mean "repeated" (as a capital value).

n the UK, all structured settlement cases to date have involved personal injury cases. In most of the cases, the extent of the injuries has been considerable .

recorded twice as a (capital) lump sum and as an annuity

I think it's just a fancy way of saying that the amount of damages has been recorded twice, as a lump-sum and as an annuity, which is why BBB the insurer is contesting the decision by pointing out the error. So maybe here you don't need a specific technical term for "récapituler" but a paraphrase explaining the double entry: the same amount of damages is recorded twice as a (capital) lump sum and as an annuity.
