En conséquence, le greffier vous invite à procéder à la signification de la déclaration d’appel dans le mois du présent avis, conformément à l’article 902 du code de procédure civile, sous peine de caducité de la déclaration d’appel ;
cependant si entre-temps, l’intimé à constitué avocat avant la signification de la déclaration d’appel, il est procédé par voie de notification à son avocat.

"Notice to be obliged to serve" ? Horrible inelegance. Any other suggestions? Maybe "Notice to serve" would be sufficient?

'Excuse' the delay, but I don't think this is a true 'notice', rather a direction from the court requiring, forciing or (AmE) summoning a party or the parties to 'effect' service : 'le greffier vous invite à procéder à la signification de la déclaration d’appel dans le mois du présent avis..'

Finding notice to serve rather ambiguous (who is giving the notice: the court or one of the parties), I am running 'scared' of *notice to proceed* (with service) as, in E&W, that 'signifies' a claimant / appellant has left it more than a year to file papers, but still want to resume the action.

I have a 'Transatlantic' hunch that our US American / Canadian colleagues will have a better idea of how to nail this odd idea of the court inviting the litigants to serve notice of appeal: see the weblink and two example sentences.
Example sentence:

Wisconsin, USA: A direction to the defendant *summoning & requiring* defendant to serve upon the plaintiff's attorney, whose address shall be stated in the summons, either an answer to the complaint if a copy of the complaint is served with the summons ..

Oregon, USA: A direction to the defendant requiring defendant to appear and defend within the time required and a notification to defendant that, in case of failure to do so, the plaintiff will apply to the court for the relief demanded in the complaint;

neutral AllegroTrans : It's a notice (by the Registrar) to serve; why is any other wording needed and how can there be any ambiguity? Could we not assume that the Registrar knows his or her onions regarding service without needing to go bothering the Judge?
