Italian term

Intervenuto disponibilita

Italian to English Law/Patents Law: Contract(s)
Heading of a contract regarding public procurement, the full sentence , for context only, reads 'Intervenuto disponibilita di Convenzioni APAC o Consip'. I understand the second part of the phrase, it is only 'Intervenuto disponibilita' I'm looking for help with

@Alex The boys came to the rescue!!
Alex O Suilleabhain (asker) Feb 18, 2022:
Paul 'The contracting authority reserves the right to withdraw from the contract if it ascertains the availability of new agreements entered into by APAC or Consip pursuant to Article 26 of Law No. 488 of 23 December 1999.' is exactly what comes below the heading!
Paul O'Brien Feb 18, 2022:
@Alex @Marco @Phil The contracting authority reserves the right to withdraw from the contract if it ascertains the availability of new agreements entered into by APAC or Consip pursuant to Article 26 of Law No. 488 of 23 December 1999.
Paul O'Brien Feb 17, 2022:
@Alex @Marco As it's Consip, they probably are framework agreements though I would need something concrete by way of "quadro" before committing. Also, they may well be "applicable", though again, I would need something more than "disponibile". Depending on the lines that follow the heading in question, we might be dealing, for example, with a invitation to bid for government procurement contracts. I mean, that's what Consip is into, right?
Marco Solinas Feb 17, 2022:
To Asker I think it should read "Intervenuta", not "Intervenuto". It could mean that the "APAC" or "Consip" framework agreements are now applicable. I suspect that Paul is right: you can probably leave out "Intervenuta".
Paul O'Brien Feb 17, 2022:
@Alex Can we see the ensuing paragraph? Are they opening bids for public contracts? I wouldn't worry about "intervenuto". Sounds like waffle to me.

Here's the context - if you post a heading, it's important also to give the text underneath.

If these new agreements become available and are more favorable to the contractor, it may withdraw from the existing contract.

ART. 33 INTERVENUTA DISPONIBILITÀ DI CONVENZIONI APAC O
CONSIP
1. La stazione appaltante si riserva di recedere dal contratto qualora accerti la disponibilità di nuove convenzioni stipulate da APAC o da Consip ai sensi dell’art. 26 della legge 23 dicembre 1999, n. 488, che rechino condizioni più vantaggiose rispetto a quelle praticate dall’Affidatario, nel caso in cui questo non sia disposto ad una revisione del prezzo in conformità a dette convenzioni.

I agree with Paul that you can ignore "intervenuta".

Italian term (edited): Intervenuto disponibilità

HAVING meantime received

Despite the strength of the discussion entries and the example sentence vs. my 'Teach Yourself Italian' and Latin crutches, I have a niggling suspicion intervenuto may not be a typo, but grammatically right: ... ho intervenuto cf. Spanish ha intervenido, so no feminine agreement.

Very unusual in my experience for incompetence if the contract had been drafted by Italian lawyers, as opposed to the burgeoning number of incompetent, semi-literate English Solicitors.

Obiter, all caps to open an English contract or judg(e)ment.

disponibilità : availiability: supply (Garzanti)
Example sentence:

... per il contraente di adeguamento ai predetti corrispettivi nel caso di *intervenuta* disponibilità di convenzioni Consip e delle centrali
