disagree bogdan burghelea Tenancy se refera la proprietate, oricat ar parea de ciudat; in ceea ce priveste diferenta dintre joint tenancy si tenancy in common, prezinta o distinctie care nu stiu daca exista in sistemul nostru juridic. La noi exista, e drept, situatiile de indiviziune si coproprietate, dar aceasta nu inseamna decat o diferenta cantitativa, nu calitativa a proprietatii; pana una alta, am putea pune problema care dintre joint tenancy si tenancy in common ar traduce mai exact termenul de indiviziune, dar aici deja intram in niste explicatii juridice care ma depasesc; pt. unele lamuriri, vezi www.popeanga.go.ro/drept/referate/rev_mob.html

In Eng. law, a joint tenancy i.e. undivided ownership of fixed or unfixeda ssets can be split by bankruptcy, divorce or by inconsistent dealings with title.

Result: takes away the jus accrescendi or 'the right of survivorship' -> The property no longer accrues automatically on death - and OUTSIDE ANY WILL made - to the joint owner, but is split into a separate estate that can be disposed of/given away/ BY WILL.

Hum, hum! Joint tenancy v. tenancy-in-common are the fedual Eng. terms for FREEHOLD ownership. ABSOLUTE ownership is ULTIMATELY vested in the Crown i.e. the Queen who takes 'bona vacantia'/uninherited land. Pls re-read your history of Eng. land law!

termination of joint tenancy
