Jennifer Levey Jan 10, 2022:
@Asker and @AllegroTrans As expected, what comes after autos para dictar sentencia is the start of the judge's summing-up, which will in turn lead on to the judgement.
Cecilia Franetovich (asker) Jan 10, 2022:
@AllegroTrans Thank you Allegro. Here is the following sentence:

VISTOS: Estos autos en estado de dictar sentencia y de
cuyas constancias,
RESULTA:
I) El día 18 de XXXXX de 20XX los cónyuges XXX y XXXX peticionan se decrete
judicialmente el divorcio en los términos previstos en los artículo...
AllegroTrans Jan 9, 2022:
Asker, more context please 1) Why is part of this in quote marks? 2) Please post the sentence following this

final pleadings/close of pleadings (pending judgment)

This is what I deduce

Now that we have more of the text, I would translate this as:

WHEREAS: These pleadings are closed and it is recorded as follows:

Thank you!
Peer comment(s):

agree Jennifer Levey : Certainly not 'final pleadings'. 'autos para dictar sentencia' is a pronouncement made by the judge to indicate that the time allowed for pleadings has expired.// Yes, 'close of pleadings' is the basic idea - now it's time for the judge to throw the dice

I deduce this to be the order for close of pleadings. What do you think?

Proceedings for judgment

Previously referred to as "proceedings for judgment";
Peer comment(s):

neutral Jennifer Levey : "Previously" ... ? Where or when?// 'Precedentemente', in this context, refers to the fact that actions have been taken respecting the established order of precedence: 'debate', then 'autos para dictar sentencia', then 'dictación de sentencia'.

Nope. "Precedentemente " is the clue.//yep, a fair point;
agree Hernan Casasbuenas : It more like the written statements to advance towards the judgment.

Yes, a prior submission to be taken into account in the judgment.Thanks.
neutral AllegroTrans : There are no additonal "proceedings for judgment"; the judgment is the culmination of the proceedings

return of the case record to the court for entry of judgment (the decree)

West >
autos para sentencia: Ecu, Uru : 'the record must be returned to the court so that it can rule'

autos en estado de dicitar sentencia: 'a case that is ripe for judgment'.

Better not all caps lest our colleague Wilsonn do object.
Example sentence:

requisition the case record so as to move to judgment

Peer comment(s):

neutral Jennifer Levey : 'return of .... decree)' may be a fair explanation of the concept, but it is not fit for purpose as a translation of 'autos para dictar sentenia'.

It's good enough for West's law dictionary and we don't know what country this is from.
neutral Andrew Bramhall : How do we know the case record was ever away from the court in question in the first place?

Best invest in a copy of West Mex etc. / AmE law dictionary that specifically refers to return of the case record to the court e.g. from the Registry.
neutral AllegroTrans : Surely the case record stays with the court? Who would dream of taking it anywhere else? // the word "return" doesn't even appear, explicitly or implicitly, in the source text...

This isn't the UK. West's law dictionary specifically labels this a Latin American process of return of the court record e.g. from the Registry.

FWIW, in Chile the equivalent step in civil procedure is called citación a las partes para oir sentencia'. It has the effect of preventing any further intervention by the parties, and sets a time-limit within which the judgement must be delivered.
