Spanish term

multa de haber

Spanish to English Law/Patents Human Resources Labour rules
In a document from Spain for translation to British English. Talking about sanctions that can be applied to workers resulting from misconduct. From the text of:

"Real Decreto Legislativo 2/2015, de 23 de octubre, por el que se aprueba el texto refundido de la Ley del Estatuto de los Trabajadores"

"no se podrán imponer sanciones que consistan en la reducción de la duración de las vacaciones u otra minoración de los derechos al descanso del trabajador o multa de haber"

The definition appears to be "la multa de haber consiste en la detracción de salario devengado o al que el trabajador tiene derecho."

What would be an English equivalent, fine against wages? fine deducted from wages?...

Discussion

Frank Foley Nov 8, 2021:
If it's a one-off fine, surely "deduction from wages" would be more appropriate than "reduction", which sounds like a more long-term arrangement?
Orkoyen (X) Nov 8, 2021:
Agree. I was thinking one-time, but rethinking, cut sounds permanent. Reduction like Robin suggests would do it
BristolTEc (asker) Nov 8, 2021:
I see suggestions of pay cuts, which I do not doubt could be options for poor performance or misconduct, but I personally think the word "multa" here suggests it is a one-off occurrence, a "fine" levied on a single occasion. Agreed?

reduction in pay

Commonly referred to as 'docking one's pay', but a legal text requires a more formal expression.

https://www.thefreedictionary.com/docked
docked, dock·ing, docks. 1. [...]. 2. To deprive of a benefit or a part of one's wages, especially as a punishment: The company docks its employees for unauthorized absences.

neutral Luis M. Sosa : Reduction sounds to a permanent type of thing, while fine is a one-time event stemming from misconduct. Reduction is illegal in some countries, not sure about Spain, but the second paragraph gives us some clue.

agree Adrian MM. : with docked pay - that has a long and distinguished pedigree from the English Truck Acts dating back over 600 years.

disagree Jennifer Levey : Asker clearly states that the ST refers to "sanctions ... resulting from misconduct" - not 'performance'.
