Ein Nachweis über die Zustellung der Klage und Ladung des Beklagten ist bislang nicht zur Akte zurück gelangt.

Does anybody have a nice legalese way of putting this? Thanks

Registered Letter Court papers are usually sent via registered letter, usually with a return postcard. That nomally takes a couple of days to makt it's way back to the sender, not even including the time documents may travel within the court. And if no one was there to receipt the letter, it will be deposited at the next post office and the recipient has 7 days to pick it up (or not if he knows what is waiting for him). If the letter is not receipted or picked up, it will be returned to the sender. The postcard can easily take a week, and two weeks if the whole shebang is sent back...

In the end IMO it does not really matter if proof of delivery is on file or on the record..

Literally, "has yet to make its way back to the file", which is a bit more colloquial, but may also be an appropriate translation depending on the context.

disagree Birgit Gläser : Nope, they mean they not yet have a confirmation that the defendant has been served... there is nothing changed or to re-enter there... this is normally sent by registered letter with a return postcard...

Literally: Proof of service of the action and summons from the defendant has not yet been returned to the file.

But what about 'not yet filed'?
It's the proof of action that is missing, not the letter.
