Reinstatement of Sums Insured A reinstatement clause is an insurance policy clause that states when coverage terms are reset after the insured files a claim. Reinstatement clauses typically do not reset a policy’s coverage limit, but they do allow the policy to restart coverage for future claims.

Why is reinstatement of the sums insured necessary following a claim?

Property damage insurance cover is subject to sums insured against specified insured property. The sum insured is the maximum the insurer will pay in the event of insured loss or damage to the insured property.

In the event of a claim, the sum insured is ‘used up’ and reduced by the amount of the claim and the cover that remains after the claim is sum insured prior to the claim less the amount of the claim.

As the insured property is repaired or replaced the value of insured property may increase in value beyond the remaining sum insured, so the sum insured will need to be increased or reinstated to a sum insured appropriate to the risk following the repair or replacement.

Tak, o to musi chodzić. Pana pierwotny tekst to bardziej coś z zakresu orzecznictwa sądowego. Nie wiem tylko czy po polsku na to też się mówi "maksymalizacja"?

Maximizing the sum insured in liability insurance means that the agreed sums insured are available several times a year in the event of several claims.



Example: sum insured EUR 250,000, maximized three times.

The maximum sum insured of EUR 250,000 is paid in the individual claim. For all claims within an insurance year, the maximum compensation is EUR 750,000 (e.g. 3 losses of EUR 250,000 each or 5 losses of EUR 150,000 each).

Maximierung der Versicherungs- summe bedeutet in der Haftpflichtversicherung, dass die vereinbarten Versicherungssummen bei mehreren Schadenfällen mehrmals pro Jahr zu Verfügung stehen.

Przepraszam, w cytacie brakuje na końcu "each with a twice a year maximization." Użyłem znaczników << >> i usunęło tekst. Będę wdzięczny za poprawienie, bo sam chyba nie mogę.
Ale o co konkretnie pytasz? Termin "maximization" nie występuje w cytowanym fragmencie.

While these three approaches may appear inconsistent, the reality is that, in general, courts adopt the theory that would maximize insurance coverage under the particular facts of the individual case. The continuous coverage/triple trigger approach is consistent with this insurance maximization theme. Coverage is triggered for any policy in existence from the time of initial exposure through manifestation of the illness.(9) The triple trigger solution represents the current trend. It maximizes the pool of insurance funds available to the insured and to claimants essentially by allowing the insured to stack every year of coverage into one large pool. For example, if an insured carried a $75 million policy, renewed annually, for twenty years, the total
amount of insurance available would be $1.5 billion, that is, $75 million times twenty years. While courts thus maximize insurance available for this "problem," e.g., asbestos or DES, they are also reducing the amount of insurance available in the future because insurers now have a strong incentive to minimize, either through denial of coverage or the use of policy exclusions, any open ended future coverage.
