OK. Then just omit the qualifiers of fair and equitable (ex aequo et bono). The web refs, though, suggest that Recht has as much the sense of justice as of the law.

establishing/determining the applicable law

I have yet to find a decent translation of this concept ("finding/extracting the law" doesn't count) but I think my solution will fit the German definition you cited.

agree Haigo Salow : determining is better than establishing, since the laws have already been established, they just need to be found and interpreted. IMO

Thanks. I think I was trying to use "establish" in the sense of "put beyond doubt/prove", based on Merriam Webster
