Portuguese term

prescrição

Portuguese to English Law/Patents Law (general)
This is being used in a legal context. I think it means limitation or injunction, but I'm not sure. Here are some examples of context:

... resolveu o MM. Juízo de primeiro grau por afastar as alegações de inépcia da inicial, ausência de interesse de agir e prescrição, assim como o requerimento de denunciação da lide,

Sendo a prescrição matéria prejudicial de mérito, a decisão que decide por afastá-la pode ser atacada por agravo de instrumento.

DECISÃO INTERLOCUTÓRIA QUE REJEITA A ALEGAÇÃO DE PRESCRIÇÃO ARGUIDA PELO RÉU.

Discussion

Mark Robertson May 17, 2019:
@ All If I was translating this, I would use both "limitation of the cause of action" and "statute barred":

The Honourable Court at first instance ruled against the defendant’s objection that the claim or cause of action is not pleaded or is unintelligible, lack of locus standi and limitation of the cause of action and rejected the application for the joinder of a third party.

As rulings on limitation are decisions on the merits, they can be challenged by interlocutory appeal.

INTERLOCUTORY RULING REJECTING THE DEFENDANT’S OBJECTION THAT THE CLAIM IS STATUTE BARRED.

Statute of Limitations

A statute of limitations is a law passed by a legislative body in a common law system to set the maximum time after an event within which legal proceedings may be initiated.
Example sentence:

"California ended its statute of limitations on rape after Bill Cosby."

limitation (of the cause of action)

Equally acceptable alternatives are:
statute-barred nature of the cause of action
time-barred nature of the cause of action
Peer comment(s):

agree Adrian MM. : Brilliant - vs. the time(-)limit for suing, perchance.....
