Julgo que "counsel" pode ter outros significados além de "advogado", "conselheiro", "consultor" etc. e o que me parece estar em causa no seu texto é a figura de um "administrador legal de bens", ou um "representante legal de bens" que pode ser acusado de má conduta por não administrar corretamente os bens da pessoa falecida.
