Fehlgebarung

German to English Law/Patents Law: Taxation & Customs Austrian sales tax
This is from a letter from a lawyer stating that its client has in the past been guilty of "Fehlgebarung" in handling the sales tax from chain transactions.

Is "Fehlgebarung" "misconduct"? "mismanagement"? I don't want to accuse someone of misconduct if that's too harsh.

Or is a Gebarung a tax disclosure, as in USt-gebarung?

Have you had a look ... ... at the various entries of "Gebarung" in the glossary? See also https://de.wiktionary.org/wiki/Gebarung (which seems to point to [financial/tax-related] mismanagement or, indeed, misconduct). We can't be sure without the complete German sentence/paragraph, though.

Could we have the German context, please. The world itself gets very few hits, and they're mostly pre-20th century. Wiktionary says Gebarung is
-ein österreichischer Begriff für Haushaltsführung (finanzielle Gebarung)
-ein veralteter Begriff für das Verhalten bzw. das Betragen

I'm not sure a lawyer would use a word like "misconduct" of their own client. Mismanagement might be OK.

Mismanagement doesn't have as much negative connotation as misconduct and could be interpreted more easily as due to carelessness or mistaken beliefs rather than negligence or intentional misbehavior.

If my lawyer has to say I was guilty of something, I'd prefer mismanagement over misconduct.
