English term
A herein
English to Spanish
Law/Patents
Patents
Hola,
Al final de una patente aparece la siguiente frase:
"The discussion of a herein is not an admission that it is prior art to the present invention".
Herein entiendo que significa "en el presente documento" pero no acabo de verle sentido en la frase anterior.
Gracias por vuestra ayuda.

There are 6 hits for the phrase. I don´t see the sense of the phrase either, and highly suspect it is a Google translation. 1) The discussion of ***a herein*** is not an admission that it is prior art to the present invention. "The discussion herein" ... would make more sense; 2) I don´t understand "prior art" either.

I agree with you, it makes no sense to me!

: See discussion entry: word missing (I believe). "Prior art" is a technical patent term: https://www.merriam-webster.com/dictionary/prior art

The discussion **of a reference herein** is not an admission that it is prior art to the present invention, especially any reference that may have a publication date after the priority date of this application.

Como no tiene sentido sin "referencia" y sí tiene sentido con esta palabra, entiendo que la versión en la que se omite es una errata.
