This comes from the beginning of an Italian Atto di Citazione template form and is the part where the where the law firm undertakes represent the plaintiff in serving a writ on a defendant.
In this case the word 'difeso' must refer to the Plaintiff and therefore cannot mean 'defendant'.
So I find myself intending to translate the phrase as ' ...that represents and acts as advocate for the Plaintiff' but there must be an English law equivalent term for this.
Any suggestions?

| thanks Hussein. Yes, I understand and it's clearly a standard wording but I am trying to understand what lies behind it so as to make it clear to readers under English Law. I have looked at the analogous forms pubished by the UK's Ministry of Justice. One complication is that the Writ Of Summons so-called for civil cases was abolished in 1999 and replaced by Civil Procedure Rules Part 7. In the these forms there is, under the part where the claimant's lawyer can sign on the claimant's behalf, the term 'litigation friend'. This is a new term and I believe it may capture the spirit and meaning of 'difendere difeso'. The idea is that the lawyer is 'defending' i.e. 'holding the hand' the client who needs defending i.e. to be looked after by a 'friend' because they are unfamiliar and not competent to carry out the claim alone. |
