Anyway The expression "não fora" anyway means "if it weren't for...", so the suggestions shall remain. I think they are all plausible, but you should stick to legalese, right?

@Mario, ´não fora' must be an air-borne disease as this is from central Portugal and yes, you are right, most of the punctuation has gone to the beach in this text and some é have mutated into e, just to add merriness.

Correct text:
"Conforme foi referido, este projeto insere-se em espaço urbanizável e, como tal, estaria sujeito a determinadas condicionantes, não fora enquadrar-se nas exceções previstas no art° 46°"
Furthermore, "não fora" is a beautiful new invention of the Brazilian legalese (it never ends, and gets worse and worse by the hour.
