the tenant is an entity that dictates to the Landlord what to do through a specially appointed "Contracting Officer"!

Taking into account that it usually happens the other way round - Landlords oppressing tenants (even big corporate tenants!) this entity must be pretty biiiiggish.

There is one that fits the bill - the US Government:

So "on balance of probability" the case should be considered as solved/closed ...

But I'm personally not big fan of "on balance of probability" as a method to be used in translating ... especially contracts.
