credit in the pursuer

English to Polish Law/Patents Law (general) possessory actions in Scots law
fragment ze szkockiej encyklopedii "Stair Memorial" dotyczący procesów posesoryjnych (w odróżnieniu od petytoryjnych):

"Since a petitiory action is one in which "some demand is made upon the defender, in consequence either of a right of property or credit in the pursuer" it covers demands to restore possession to the rightful possessor."

"defender" po szkocku to oczywiście "defendant" czyli pozwany
"pursuer" to "plaintiff" czy "claimant" czyli powód

Jak byście przetłumaczyli to "credit in the pursuer"?

Być może chodzi o prawa rzeczowe i prawa kredytowe powoda/strony powodowej / przysługujące powodowi (real rights [in rem] or credit-related rights). Ale to tylko wróżenie z fusów. Bez konsultacji ze specjalistą pewności brak.

Hence petitory, adj., characterised by supplication and soliciting, petitionary, putting forth a claim; specif. in Sc. Law comb. petitory action, an action raised by means of a Petition, q.v., by which a judge is requested to exercise his jurisdiction on behalf of the petitor or petitioner in respect of some rights of property or credit pertaining to him
