trateze cererea fără a notifica

cererea = e vorba, bineînțeles, de o cerere în instanță

In almost every court application, the other party must be given notice of
the application. You do this by serving them, which is by handing them
copies of the court forms that you have filed.
A court application made without notice to the other party is called an ex
parte application. There are some very limited cases where you can
make an application without first serving the other party. Some examples
are:
• You have searched carefully for the other party, but they have
completely disappeared; or
• Your case is an emergency in that your safety or your children’s
safety is at risk if you serve the other party ahead of time.

neutral Liviu-Lee Roth : este o diferență între „hear an application” și „consider an application”

instanta sa examineze cererea dvs fara notificarea paratului

hear e cam impropriu in cazul unei cereri sau petitii scrise, probabil ca se subintelege sustinerea ei orala in instanta
