Real Estate
A. Mineral estate
Although land and mineral rights are governed by state law, there is nationwide consensus on certain fundamental legal principles. The ‘mineral’ estate is generally said to own the rights to the oil, gas and other types of minerals. Thus, where the surface estate and mineral estate are owned separately, the rights to any natural gas fall within the mineral estate. Under common law, any conflict between the two estates over use and enjoyment of minerals is typically resolved in favour of the mineral estate.

For example, if a person owns a property, the property deed should specify that state ownership is “fee simple” which means that the owner has a right over both on the surface of land and its mineral deposits. Otherwise, someone else may own mineral properties on the tract.
The following is an example of the state statute defining mineral, oil and gas property:
Cal Bus & Prof Code § 10503: Mineral, oil and gas property refers to the land used for the mining of minerals or the extraction of oil or gas therefrom.

Mineral estate
Ownership of mineral rights (more properly "mineral interest") is an estate in real property. Technically it is known as a mineral estate, although often referred to as mineral rights. It is the right of the owner to exploit, mine, and/or produce any or all of the minerals lying below the surface of the property.
The mineral estate of the land includes all organic and inorganic substances that form a part of the soil. Exceptions include sand, gravel, limestone, and subsurface water—which are normally considered part of the surface estate.
