I am not sure whether to use : petitioner or prosecutor
and respondent or defendant in a translation of an affidavit. here is some context:

לאחר שלא צלחו הנסיונות של בא כוחי להוציא לפועל את העסקה לא נותר לתובעת אלא לפנות אל בית המשפט בתביעה-
- לכל אורך התקופה שניהלתי משא ומתן עם הנתבעים.....
- בתגובה שהוגשה מטעם הנתבעת 1
etc.

I wouldn't go for either of your options (certainly not in an ordinary civil claim which is what this seems to be).
