"L’Acquéreur reconnaît avoir été informé des sanctions prévues par l’article 1764 du Code général des impôts en cas de non respect de son engagement de conservation de la moitié indivise des Biens Immobiliers pendant cinq ans (amende dont le montant est égal à 25% de la valeur de cession de l’immeuble acquis ** sous le bénéfice ** de l’article 210 E du Code général des impôts)."

Other context:

"(vii) qu’il remplit, sous réserve de l’engagement de conservation visé ci-après, toutes les conditions, tenant à sa personne, permettant au Vendeur de bénéficier des dispositions de l’article 210 E du Code général des impôts."
In this second instance, I've used 'to take advantage of...'

The meaning is clear - under certain conditions (set forth in Article 210 E, one of which is to hang onto the property purchased for five years), capital gains are subject to a highly favourable rate of tax. However, I am struggling to word the translation.

I don't see any concrete difference between "as per/according to/subject to/as afforded by/under the terms of" - isn't that the deep structure here?

sous bénéfice de usually means the same as sous réserve de i.e. subject to or, in this case, under the terms of

Thanks Jonathan, but that use of 'sous le bénéfice de' seems not to be what is meant in this instance. I probably should have worded my question more clearly.

"Droit de n’admettre une chose qu’avec certaines réserves.
