English term
regular proceedings vs summary proceedings
English to Russian
Law/Patents
Law (general)
The Supreme Court stated that when a court in regular proceedings has rendered a judgment, a court in subsequent summary proceedings must conform its decision to the judgment of the court in regular proceedings, safe for exceptional circumstances.

Question: I searched for an explanation, but I could only get definitions. What I want to know is that how summary proceeding differs from usual proceedings. Please explain.
Answer: I assume you are in England & Wales. If so this is the answer to your question:
Some criminal offences are triable summarily. This means that they can be tried by a Magistrates Court and the matter of guilt will be decided by one Stipendiary Magistrate or one Stipendiary magistrate sitting with one or two lay magistrates.
More serious offences such as robbery and theft are triable either way. This means they can be tried by a Magistrate if the offence is relatively minor but falls within the category of triable either way offences or it may be committed to the Crown Court for trial by jury.
The most serious offences such as rape and murder are triable on indictment only. This means that these must be tried by a judge and jury at the Crown Court and the defendant has no choice of venue.
This is it in a nutshell. If you want to know more than that you need to buy a book on criminal law procedure. Hope it helps.
For the record I am a criminal defence solicitor. http://www.freelawanswer.com/law/2286-2-law-2.html

In your reply you've used the term "обычное производство". So may I use here such terms as "суд обычной инстанции" "суд высшей инстанции"?
You see, this text is intended for general public, not only for law specialists, so it is to be as clear as possible.
Sorry for lack of the context, it is just one passage.
Thanks again for your kind support.
