The paragraph reads La partie requerante doit faire preuve de diligence et introduire son action sans laisser s'ecouler un delai qui serait preuve de la negation de l'urgence. Il est rappele que le recours a une telle procedure (suspension of a desicion on the ground of extreme urgency) doit des lors rester exceptionnel et ne peut etre tribiutaire du bon vouloir de la parties requerante. Il ne peut par consequent etre admis. I don't like my translation becuase I'n not sure that 'at the whimof the applicant' is formal enough.

Could we have some more context please? We only have one sentence - what comes before and after this? What is "une telle procédure"? And why don't you like your own translation?

It's not 'goodwill' in this context Sorry, I should have been clearer - the context is legal proceedings. The decision of the appeal court is that 'une telle procedure doit rester exceptionnel et ne peut etre tributaire du bon vouloir ....' It therefore seems to me that it would be the desire/wish/whim of the other party rather than its goodwill.

Also there is 'goodwill' in the legal sense
