Hannah, you are right of course. I used "accessory" as an adjective and in connection with "... to the contract". "Accessory" as a substantive in connection with "before/after the fact" are terms of criminal law.

Yes, Hannah, the translation is of an actual contract, not a proceeding. I personally have not come across it in this context yet.

I have tried in my notes to show difference between terms secondary, accessory, intermediary, third party etc. - depending on context and an area of law they are not synonyms.

I think the terms secondary, accessory, intermediary, third party are synonymous. I interpret that in this case the third party is a witness and is not involved in the matter of the contract. My interpretation is that accessory is somewhat involved in the issues.

Český OZ nezná termín "vedlejší účastník smlouvy", "vedlejší účastník" je institut civilního procesní práva (par. 93 OSŘ). Našel jsem jen tři odkazy mj. "Okolnost, že k zástavní smlouvě byl jejími účastníky přibrán jako "vedlejší účastník" dlužník zajišťované pohledávky (obligační dlužník) MVDr. P. Š., nic nemění na závěru, že se řízení zúčastnili oba (všichni) účastníci napadené smlouvy, neboť o právech a povinnostech obligačního dlužníka se v zástavní smlouvy nejednalo (nemohlo jednat) a jeho "vedlejší" účast na smlouvě nemá (nemůže mít) vliv na právní postavení zástavního věřitele a zástavce. I could not find it either perhaps it is not used in Anglo-Saxon law ..

So far the accessory participant (or perhaps secondary participant) makes the most sense, exactly because the other suggested terms are used in other legal contexts. However, I would like to find it used in a similar context to what I need, but so far have been unsuccessful..

In the meantime hided answers "enjoined party" and "intervener", and also "interpleader" are terms used in civil proceedings for "vedlejší účastník"
