Die Bürgschaft hat die Erklärungen zu enthalten, dass auf die Einreden der Anfechtung und der Vorausklage gemäß §§ 770 Abs. 1, 771 BGB sowie wegen bestrittener und nicht rechtskräftig festgestellter Forderungen auch auf die Einrede der Aufrechenbarkeit mit Forderungen gemäß § 770 Abs. 2 BGB verzichtet wird.
The surety must contain a declaration waiving the right to contest and the defense of failure to pursue remedies according to §§ 770 item 1, 771 BGB as well as stating that, with regard to claims that are disputed or against which legal recourse is possible, the right of offset with (respect to) claims according to § 770 item 2 BGB is also waived.
I believe it should be right "of" offset in this case, not "to"offset.

defense of set-off
The legal defense of set-off (above) was originally introduced to prevent the unfair situation whereby a person ("Party A") who owed money to another ("Party B") could be sent to debtors prison, despite the fact that Party B also owed money to Party A. The law thus allows both parties to defer payment until their respective claims have been heard in court. Upon judgment, both claims are extinguished and replaced by a single net sum owing (e.g. If Party A owes Party B 100 and Party B owes Party A 105, the two sums are set off and replaced with a single obligation of 5 from Party B to Party A).

Offset is a printing process.
If the plea is waived, then the entire debt is accepted.

Legally, it's a set-off. Mathematically, it's an offset, even if found in legal texts.

Thanks. Yes, I was aware of that. But offset can be found in legal texts. So can offsetting and right of offset or right to/defense of set- off. see: http://www.3rdcoa.courts.state.tx.us/opinions/htmlopinion.asp?OpinionId=16877 The right to an offset is an affirmative defense.
