Der Auftragnehmer nimmt zur Kenntnis, dass er als Fremdunternehmer gemäß § 134 Mineralölgesetz vor Aufnahme der ihm übertragenen Tätigkeit der zuständigen Behörde die für die Leitung und technische Aufsicht verantwortlichen Personen unter Angabe der Aufgabenbereiche und Befugnisse bekanntzugeben und nachzuweisen hat, dass die namhaft gemachten Personen über hinreichende Kenntnisse im Sinne dieser Bestimmung verfügen, außer es handelt sich dabei ausschließlich um Tätigkeiten gewerblicher Natur, die *obertags* durchgeführt werden.

Contractor acknowledges that, in accordance with §134 of the law concerning mineral raw material, it is his responsibility as a foreign company, prior to beginning the assigned work, to satisfactorily identify all persons responsible for management and technical supervision under specification of their fields of duty and authorizations and that he must show proof that the named persons have the necessary knowledge within the meaning of this provision, unless the activities are exclusively of a commercial nature, carried out *......*.


Above ground came to mind, ...but I hope for an expert opinion.

Mineralölgesetz is certainly not "the law concerning mineral raw material"! Mineralöl is simkply "oil" or "mineral oil". Try the "Mineral Oil Tax law"/"mineral oil taxation law".

agree Nicola Wood : Visited several mines here in Austria recently. The tour guides are always old miners and they always refer to above ground as obertag and down the mine as untertag
