交付审判 / 移送法院

移送审判程序(committal for trial),也可以称为交付审判程序或预审程序。举行这种程序的目的在于,由治安法官对那些按照公诉书(indictment)起诉的可诉罪(注:英国的犯罪若按照对审判方式的影响来分类,可包括简易罪(summary offences)、可诉罪(indictable offences)和可以选择审判法院的罪行(offences triable either way)三种。可诉罪是只能由刑事法院按照正式起诉程序进行审判的犯罪,对这种犯罪进行审判,必须有陪审团参加。)案件进行审查,以确定控诉一方是否有充分的指控证据,案件是否有必要移送刑事法院举行的法庭审判,从而保证被告人免受无根据的起诉和审判。移送审判不是一种审判程序,因为法官在这种程序中不对被告人是否有罪作出任何裁断,被告人也没有作出有罪或者无罪答辩的机会。法官在这种程序中所能作出的只能是撤销案件的决定或者移送刑事法院审判的决定。目前在英国,绝大多数的可诉罪案件在刑事法院进行审判之前,都要经过由治安法院举行的预审程序。
