(‏(العلماء المجتهدين) (في الفقه والشريعة
so maybe the simplest is best. We generally use "diligent" in reference to students, not scholars; it's assumed that all scholars are diligent, by definition. Another possibility: "scholars specializing in fiqh and sharia". A literal translation is not really feasible.

i.e. I think this is a صفة صريحة بمنزلة الفعل and not a نعت , so a simple adjective in English seems not quite right; a gerund is more appropriate.

الاجتهاد: الذي هو استفراغ الجهد في الوصول إلى الأحكام الشرعية التفصيلية، الراجعة في كلياتها إلى مصادر التشريع المتفق عليها.
والاجتهاد له نوعان:
أحدهما الاجتهاد الإنشائي: وهو استنباط حكم في مسألة من المسائل، سواء كانت قديمة أم جديدة، وهذا الاجتهاد غالباً ما يكون في المسائل المستجدة التي لم يعرفها السابقون ولم تكن في أزمنتهم.
الثاني: الاجتهاد الانتقائي: ويكون باختيار أحد الآراء المنقولة عن الفقهاء السابقين، ليصار إلى الإفتاء به، أو القضاء بمقتضاه، ترجيحاً له على غيره من الآراء والأقوال الأخرى.
ويعتبر المجتهد الذي يمتلك ناصية نوعي الاجتهاد مجتهداً مطلقاً، بينما يعد المجتهد في إطار الانتقاء والترجيح مجتهداً منتسباً، أو مجتهداً في المذهب أو في الفتوى.
إن الاجتهاد قضية مسلَّم بها، فقد اجتهد رسول الله صلى الله عليه وسلم في بعض القضايا التي سئل عن حكمها، فكان صلى الله عليه وسلم يفتي السائل إذا تأخر الوحي عن بيان الحكم. ولكن نقول: إن هذا الاجتهاد منه صلى الله عليه وسلم لا يعتبر مصدراً مستقلاً لأنه يرجع إلى الوحي في واقع الأمر، من بيان وجه عدم الصواب، أو الإقرار بالصواب.

الكلمة " المجتهدين" هنا في السياق الديني عن الفقه و الشريعة.. معناه ليس مجردا بمعنى " بذل الجهد" ضد "كسل"... بل بالمعنى المصطلح...أي: العلماء الذين وصلوا إلى درجة الإجتهاد في المسألة الدينية أو الفقهية...ليس كل عالم يبذل جهوده في طلب علوم الدين فأصبح " مجتهدا" بل الإجتهاد هنا له معنى خاص كما بيننا أعلاه
فالعبارة المصدرة " العلماء المجتهدين في الفقه والشريعة" معناها : " العلماء الذين وصلوا إلى درجة الإجتهاد في مجال علوم الدين/ في الفقه و الشريعة "
الكلمة " المجتهدين" هنا صفة للعلماء و ليست "بدل" له

Diligent/hard working/well-versed etc, only have the literal meaning of “ mujtahid”, they don’t have its theological meaning in religious context, which means “ who is capable of /qualified for ‘ al-ijtihad’ ” . In religious context, “ mujtahid” is a technical/ theological term, not every well-informed/well-versed scholar can be called “mujtahid”, especially nowadays when most people might think who has a title of “doctor” in religious studies, then he will be considered as a “mujtahid”, then he might give “fatwas” on his own website, however this is not the case, “doctorate” never ever means “mujtahid”.
Innovative, it might imply the negative meaning of this word in religious context which means “ ahlu al-bi’da’a” ( mubtadi’).

Conclusion: the Mujtahid scholars = العلماء المجتهدين

A Shari'ah scholar does not earn the adjective of عالم مجتهد unless one is called upon to find solutions to new problems. Merely being hard working, proficient, assiduous, diligent, etc is not enough. The innovation is not in the Shari'ah itself but in applying rules of Shari'ah.

I agree with hc_ha that the word "innovative" might imply the negative meaning of this word in religious context which means “ahlu al-bi’da’a” (mubtadi’).

With all due respect to all the colleagues who have honored me with their agreement to my suggestion, I now think "innovative" could imply a negative sense unless accompanied by an explanation that innovation is in applying the principles of the Shari'ah, not in the Shari'ah itself.

In Islamic economics many terms of Arabic origin have become accepted in English, such as "murabaha", mudaraba", "ijara", etc.
The term "mujtahid" has no exact equivalent in English and ought to remain as is (transliterated) perhaps accompanied, initially, with an explanation in parenthesis.
