Hello everybody,

This comes from the following sentence:

'Car cette punition automatique ne correspondait pas aux pratique de la justice 'ordinaire', pénale ou civile, toujours friande d'éléments circonstanciels et personnels'.

The general context is the World Anti-Doing Conference and the struggle between WADA (World Anti-Doping Agency) and the signatories of the In ternational Anti)-Doping Code who for the large part don't follow code, particularly in relation to giving reduced or longer bans than those stipulated in the code (punition automatique). The CAS (Court of Arbitration for Sport) tries to settle disputes but often undermines the code itself as it follows ordinary(???), criminal and civil law that all take into account extenuating circumstances.

agree Graham macLachlan : I think you are quite right but perhaps 'conventional law' to tie in with the civil/penal bit//good point, perhaps ..."conventional" law... would solve that?

thanks, I avoided "conventional law" as it points towards international conventions which isn't the case here

that's what I thought at first too, but is common law not a system based on precedence or case law (droit coutumier), as oppodosed to civil law?
