Po zahtevu tužioca, sud može odložiti izvršenje konačnog upravnog akta kojim je meritorno odlučeno u upravnoj stvari, do donošenja sudske odluke, ako bi izvršenje nanelo tužiocu štetu koja bi se teško mogla nadoknaditi, a odlaganje nije protivno javnom interesu, niti bi se odlaganjem nanela veća ili nenadoknadiva šteta protivnoj stranci, odnosno zainteresovanom licu.

on the merits

adj. referring to a judgment, decision or ruling of a court based upon the facts presented in evidence and the law applied to that evidence. A judge decides a case "on the merits" when he/she bases the decision on the fundamental issues and considers technical and procedural defenses as either inconsequential or overcome. Example: An attorney is two days late in filing a set of legal points and authorities in opposition to a motion to dismiss. Rather than dismiss the case based on this technical procedural deficiency, the judge considers the case "on the merits" as if this mistake had not occurred.

On January 21, 2015, the Constitutional Court will judge on merits of constitutional complaint filed by the International Society for Fair Elections and Democracy (ISFED) and Georgian Young Lawyers’ Association. Due to its special importance, the case will be examined by the plenum.

Na drugoj strani, ustavni sud ne oslobađaju odgovornosti niti očigledan politički sadržaj ustavnog spora niti značajne političke posledice njegove buduće odluke, ukoliko doista postoje sve procesne pretpostavke za njegovo meritorno odlučivanje.
