German term

Bezifferte Schäden

German to English Law/Patents Insurance
The context is as follows:
A person suffered severe injuries as a result of which his Krankenkasse had to pay very siginificant hospital, nursing and home care costs; the home care costs will also continue for a long time into the future.

The Krankenkasse is now attempting to recover its costs from the manufacturer of the product that caused to person to suffer the injuries and/or the company's third party liability insurer.

No out of court settlement can be reached so the krankenkasse is resorting to the courts. The statement of claim contains a number of tables with different types of costs, all of which are introduced by the heading:

"Bezifferte Schäden der Klägerin
Die Klägerin hatte aufgrund des Vorfalls als Krankenversicherung der geschädigten Person u.a. die nachstehend dargestellten und erbrachten Leistungen zu erbringen:"

Could someone please help with the correct term used in the insurance world?

Many thanks.

Ramey Rieger (X) Nov 17, 2013:
Hesitation noted and shared. I am quite familiar with the English use of 'estimated damages', but in quite another context. We shall see.....
Lancashireman Nov 17, 2013:
Dame Ramey I followed it but did not find ultimate enlightenment. Please note the ultra-hesitant used of the question mark after 'itemised claims'.
Ramey Rieger (X) Nov 17, 2013:
Good evening Sir Andrew! If you follow the link to Wikipedia, there is an exhaustive definition of
'beziffert'. What do you think?
Lancashireman Nov 17, 2013:
itemised claims?
Ramey Rieger (X) Nov 17, 2013:
It is a list? List of damages? I'm still looking, but have yet to find exactly this term in the dics.

(BrE) quantified damages and losses

As per Phil G., whilst losses are added for a sweep-up or mop-up.

In the UK, likely to be special vs. general damages, the latter - like pain & suffering - assessed by the court.

assessed damages

Plaintiff's assessed damages:

See example below:

"The Court of Appeal held that trial judge was correct and dismissed the defendant’s appeal. The legislation was clearly worded at s.267.5(9) – statutory deductions from a plaintiff’s assessed damages are not to be considered in determining a party’s entitlement to costs."
