Eu encontrei uma única referência em inglês a esse princípio que vem do direito romano, por isso o latim. Mas seria uma maneira bem clara de explicar a questão.

merger of offenc/ses
I agree that the idea is one of subsuming of offenc/ses, but there is something similar in Anglo-Am. law.
Notes
1. I don't think that principle exists in UK law > it usually does, but the problem is one of recognition and identification
2. the doctine of merger also exists in UK conveyancing, namely merger of the contract of sale into the final conveyance of land aka incorporation in US Am. law.
3. In the UK, there is a related exhortation not to 'overload' criminal indictments means prosecutions ought to be for the most serious offence e.g. murder and breaking a window to gain access to the victim need not be included as criminal damage as a count in the indictment.
4. no. 2 numerical confidence level as numbers well downwards from 4 & 3.
