Here, the matter or problem not being dealt with is that of the (absence of any) criminal record. Therefore it's existence cannot be excluded...

neutral Daryo : "délits éventuels commis" is strictly speaking not correct a "criminal record" is only about those crimes where the perpetrators were caught AND sentenced ...
