Source text - Spanish Desde la irrupción en 2004 del terrorismo islamista radical en España a través de los atentados del 11 de marzo en Madrid, una gran cantidad de recursos públicos se han ido ajustando progresivamente a las características propias de este fenómeno para hacerle frente. El refuerzo de la cooperación internacional, el redireccionamiento de los recursos personales y materiales tradicionalmente aplicados a la lucha contra ETA, así como las sucesivas reformas legislativas, muestran cómo el terrorismo islamista se ha convertido en nuestro país en un asunto de primera magnitud. Nuestro legislador así lo expresa con total contundencia en el preámbulo de la LO 2/2015, donde sostiene que estas acciones terroristas “pretenden poner en riesgo los pilares en los que se sustenta el Estado de Derecho y el marco de convivencia de las democracias del mundo entero”.
Translation - English Since the eruption of radical Islamic terrorism in 2004, caused by the Madrid attacks on March 11, a great number of public resources have gradually adjusted to the characteristics of this phenomenon in order to tackle the problem. The reinforcement of international cooperation, the redirection of personal resources and materials traditionally applied to tackle ETA4 , as well as the successive legislative reforms, show how Islamic terrorism has become a crucially important topic in Spain. Spanish legislative firmly expresses it as such in the preface of the Organic Law 2/20155, where it states that these terrorist actions "intend to put foundations that support the Rule of Law and the framework of coexistence between democracies around the world at risk”.

Source text - Spanish En el presente trabajo se pretende analizar la racionalidad de la toma de decisiones de política legislativa penal en el ámbito concreto de la delincuencia juvenil. Para ello, se va a centrar el análisis en el discurso del legislador durante la fase de tramitación parlamentaria de dos de las reformas que de manera más intensa han modificado la regulación de la responsabilidad penal de los menores de edad en España. En concreto, se pone de manifiesto la irracionalidad del legislador español, fundamentalmente en los niveles ético y teleológico. Por lo que respecta a la primera, como se verá en estas páginas, se produce en la medida en que se resta relevancia al principio del interés superior del menor, que debería inspirar prioritariamente al sistema de justicia juvenil, dando entrada a los principios de prevención general negativa y positiva, y a las finalidades retributivas de la sanción; igualmente, se podría estar vulnerando el principio de correspondencia con la realidad, en la medida en que el legislador justifica la necesidad de la reforma en un supuesto incremento de la delincuencia juvenil que habría generado en la sociedad una sensación creciente de inseguridad y desconfianza hacia las normas, no habiendo contrastado si esto es cierto. Por lo que respecta al segundo nivel de racionalidad (teleológica), podría estar ausente en las decisiones finalmente adoptadas que ignoran los intereses de las diversas fuerzas ideológicas y las necesidades reales de protección e intervención que han puesto de manifiesto. Además, también se podría hablar de irracionalidad pragmática, en la medida en que el legislador amplía los supuestos en los que se pueden imponer sanciones o prevé consecuencias jurídicas que suponen un incremento del gasto, pero, sin embargo, no dedica recursos suficientes para poder aplicarlas, como ponen de manifiesto tanto las diversas investigaciones empíricas que se mencionarán en estas páginas y los propios parlamentarios durante las sesiones de tramitación de las leyes analizadas. Translation - English This study aims to analyse the rationality of decision-making in criminal legislative policy, specifically in the juvenile crime field. In order to do this, the analysis will focus on the legislator’s discourse during the parliamentary processing stage of two amendments which have modified the regulation of criminal liability of minors in Spain to the highest extent. In particular, it will highlight the irrationality of Spanish legislators, mainly on ethical and teleological levels. With regard to the ethicality, it occurs when relevance to the principle of the best interests of the minor is played down, as will be seen in this piece of work, which should mainly inspire the juvenile justice system. This gives way for the principles of general negative and positive prevention and the retributive purpose of the penalty. Similarly, it could be violating the principle of correspondence with reality, with the legislator justifying the need for a reform with a supposed increase in juvenile crime which would have generated a growing feeling of insecurity and distrust towards laws within society, without having confirmed if this is true. With respect to the second level of rationality (teleological), it could be absent in final decisions that ignore the interests of diverse ideological strengths and the real need for protection and intervention that has been expressed. Moreover, pragmatic irrationality could also be considered, in such a way that the legislator expanded the assumptions in which penalties can be imposed or predict juridical consequences that suppose a rise in expenditure. However, sufficient resources are not provided to apply them, which has been mentioned both by diverse empirical investigations which will be mentioned later in this study and the Parliament members themselves during the processing sessions of the laws analysed. In this respect, laws which imply the greatest use of non-custodial measures will not be effective, with it no longer being possible to apply them appropriately due to insufficient resources, nor will those that suppose that a greater infliction of closed detention centres, since they do not comply with one of its main objectives: avoiding the recidivism.
