Ce 1er juillet, la fiscalité de l'assurance-vie est augmentée. Et l'on attend toujours les décrets d'application d'un nouveau produit plus intéressant...
Les impôts ne baissent pas pour tout le monde. Ce 1er juillet, les bénéficiaires de contrats d'assurance-vie à la suite du décès de leur titulaire sont plus taxés. En juillet 2011 déjà, le gouvernement avait créé un barème d'imposition au-delà de l'abattement de 152 500 euros par bénéficiaire. La taxe était de 20 % jusqu'à 902 338 euros et de 25 % au-dessus. Depuis le 1er juillet, les 20 % ne concernent plus que les capitaux inférieurs à 700 000 euros et le taux de 25 % grimpe à 31,25 %. Une sacrée différence. "Pour un bénéficiaire de 1 million d'euros, la facture passe de 169 500 à 186 094 euros (+ 9,7 %)", a calculé Marie-Hélène Poirier, directrice juridique et fiscale de Swiss Life. Pour 2 millions, la note est passée en trois ans de 369 500 à 416 733 euros (+ 35 %).
À la même date devaient entrer également en application les nouveaux contrats d'assurance-vie dits "vie génération". Mais on attend toujours les décrets d'application prévus en juillet. Résultat, aucun assureur ne peut pour l'instant en proposer. Dommage, car ils sont assortis d'une carotte fiscale. Ils bénéficient d'un abattement de 20 % qui s'applique sur les capitaux reçus avant même l'abattement de 152 500 euros. "Le bénéficiaire de 1 million d'euros provenant de ce type de contrat ne paierait que 129 500 euros soit moins qu'aujourd'hui et surtout moins que demain", souligne Marie-Hélène Poirier.
Diversifier le nombre de bénéficiaires
Mais ces contrats sont assortis d'une condition draconienne : être investis 100 % en unités de compte (exit le fonds en euros), dont 33 % en actions de PME, dans le logement ou l'économie sociale et solidaire. Et ce, tout au long du contrat. Pas possible d'y échapper à l'occasion d'un retrait, d'un arbitrage ou d'un versement. Seule l'évolution des performances permettra de déroger à cette règle.
"Ce type de contrat s'adresse surtout aux personnes de moins de 70 ans qui ont un problème de transmission et qui disposent d'un gros patrimoine leur permettant de supporter cette diversification", commente Marie-Hélène Poirier. Pour les autres, il existe des solutions : la plus simple consiste à diversifier le nombre de bénéficiaires en pensant notamment aux petits-enfants, la seconde à démembrer la clause bénéficiaire pour une partie au moins du capital.

Tax rates on life insurance will rise from the 1st of July; meanwhile, implementation policies for a newer, more lucrative type of contract remain unknown.
Tax rates are falling, but not for everyone. As of July 1st, beneficiaries of life insurance policies will now pay more tax upon the death of the policy holder. In 2011, the government had already applied a new tax scale, applicable to beneficiaries set to receive over €152,000. The tax rate was 20% up to and including €902,338, and 25% beyond that figure. As of July 1st, the 20% rate will only apply to inheritances of less than €700,000; in addition, the 25% rate will climb to 31.25% - quite a difference. Marie-Hélène Poirier (Legal and Financial Manger at Swiss Life) calculates that, for a benificiary standing to inherit a million euros, the tax bill rises from €169,500 to €186,094 (+9.7%). For €2 million, the bill has gone from €369,500 to €416,733 - a 35% rise in three years.
On the same date, new life insurance policies known as 'Life Generation' (‘vie génération’) will also come into effect, though we are still awaiting their implementation policies (due to be released in July). As a result, insurance companies are currently unable to offer them - which is a shame, as they appear to represent a fiscal carrot of sorts. They benefit from a 20% tax abatement on funds inherited, even before the standard abatement of €152,000. “Under this type of contract, a beneficiary set to receive €1 million would pay only €129,500: less than they pay today, and certainly less than they will in the future,” says Marie-Hélène Poirier.
Naming Multiple Beneficiaries
But these contracts come with a draconian string attached: they must comprise 100% investment in units of account (say goodbye to hard currency), of which 33% must be shares in small and medium businesses, in housing, or in economic policies aimed at universal social welfare - and all of this for the entire duration of the policy. There’s no getting around it, whether you retire, seek a ruling or transfer funds elsewhere; only developments in performance will allow the holder any departure from this rule.
“This kind of contract is of interest to individuals under the age of 70 with problematic inheritances, who are in possession of a large estate allowing them to absorb this kind of asset spread,” notes Marie-Hélène Poirier. For others, there are alternative solutions: the most straightforward being to name multiple beneficiaries (think particularly of grandchildren), or else by keeping at least a portion of the capital separate from the beneficiary named in the policy.

En s'imposant à Paris (22-20), l'Irlande remporte le Tournoi 2014 et offre une magnifique sortie à O'Driscoll. La France a montré un bien meilleur visage.
Malgré un état d’esprit irréprochable et une réelle envie de bien faire, le XV de France n’est pas parvenu à s’imposer au Stade de France face à l’Irlande (20-22). Plus expérimentés, plus disciplinés, plus soudés mais moins joueurs, les hommes de Joe Schmidt ont étouffé les initiatives françaises pour s’adjuger cette précieuse victoire. L’histoire est belle pour le XV du Trèfle qui offre le trophée du Tournoi des VI Nations 2014 à son trois-quarts centre emblématique, Monsieur Brian O’Driscoll, pour sa 141e et dernière sélection internationale. Les Bleus pourront se satisfaire de priver les Anglais de titre…
Après la leçon de rugby que les Anglais ont infligé aux Italiens à Rome (victoire 52-11), le gain du Tournoi était déjà à oublier avant même le coup d’envoi pour les Bleus. Mais bien plus que la récompense d’un trophée qui eut paru immérité, le XV de France se devait de montrer un autre visage que celui des deux derniers matchs. Vitesse, audace, solidarité, intelligence. Les Français ont prouvé qu’ils avaient une équipe capable de produire un jeu alléchant, porté sur l’attaque. Mais c’est encore insuffisant.
Dès l’entame du match, on a senti que les Bleus avaient à cœur de se racheter et surtout de laisser éclater leur frustration d’un Tournoi en demi-teinte. Mathieu Bastareaud perçait à plusieurs reprises et multipliait les percussions ; Gael Fickou lui emboitait le pas, virevoltant grâce à ses appuis. Maxime Machenaud sanctionnait deux fois les erreurs irlandaises (6-0, 14e). Mais l’Irlande n’est pas favorite pour rien. En cinq minutes et deux attaques, les Diables Verts parvenaient à aller en terres promises (Sexton, 20e et Trimble, 25e pour porter le score à 6-12), il est vrai aidés par des erreurs grossières de Thomas Domingo (pénalisé à trois reprises pour sa liaison en mêlée en première période et remplacé à la mi-temps et avec succès par Vincent Debaty) et Louis Picamoles (auteur d’un en-avant d’école sans pression). Les Bleus, touchés au vif, revenaient de suite au score sur une belle transversale de Rémi Tales volleyée dans les airs par Yoann Huget sur son aile pour Brice Dulin (13-12, 30e) pour le 150e essai français inscrit au Stade de France.
Bastareaud éteint Sexton… Dommage, l’Irlandais avait frappé le premier
Mis devant le fait accompli par le staff irlandais, les coéquipiers de Jonathan Sexton, une nouvelle fois étincelant, faisaient plier les Bleus en dix minutes au retour des vestiaires. L’ouvreur du Racing (les supporters Ciel et Blanc peuvent crier à l'injustice...) marquait son deuxième essai de la partie (son quatrième du Tournoi !) suite à une percée de son ailier Trimble, bien relayé par Brian O’Driscoll (13-19, 47e). Le XV de France perdait alors en lucidité, voyant venir le spectre d’une nouvelle défaite. 10-0 en dix minutes et + 9 au score à vingt minutes de la fin, les Français se faisaient lentement manger à la sauce irlandaise, composée d’une conquête toujours aussi excellente (78% de mêlées et 93% de lancers réussis), de mauls toujours aussi bien exécutés et de coups de pied de pression dont eux-seuls ont les secrets.
La percussion de Bastareaud sur Sexton, laissant le demi d’ouverture KO quoique conscient, arrivait trop tard. Lentement mais sûrement les Irlandais tenaient leur sacre dans une fin de match soporifique et fêtaient de la meilleure des manières la dernière sortie de leur légende. On ne s’en plaindra pas. D’autant plus que même si les Bleus tombent, on a (enfin !) vu du JEU, des attaques pleines de vitesse, des avants au soutien. Du vrai rugby. Tant pis pour la victoire mais cette équipe à une âme. Et en plus, les Anglais nous détestent toujours autant.

Ireland will take home the 2014 Six Nations trophy with a 22-20 victory in Paris, providing a glorious send-off for Brian O'Driscoll. The French, meanwhile, turned over a new leaf.
Despite their flawless attitude and a real desire to succeed, the French team could not prevail against Ireland at the Stade de France. Though not as daring, Joe Schmidt's men were more experienced, more disciplined and more solid, managing to smother French advances and earning themselves a precious victory. It is a fairytale story for the 'Shamrock 15', who dedicated the 2014 Six Nations trophy to their emblematic centre, Mr Brian O'Driscoll, for his 141st and last international appearance. Still, Les Bleus will take some solance in having kept England away from the title.
Even before kickoff, thoughts of winning the tournament were a thing of the past for France after England inflicted a rugby masterclass upon the Italians in Rome (winning 52-11). Still, a greater payoff than a trophy that would have seemed undeserved was a French squad determined to show a different side of themselves. In contrast to their last two matches, France played with speed, audacity, solidarity and intelligence. The squad proved they were capable of producing a captivating game, full of attack - but it still wasn’t enough.
From the outset, it was clear that the French team were keen to redeem themselves and to vent their frustration after a lacklustre tournament. Mathieu Bastareaud broke through on several occasions, racking up hits as Gael Fickou followed his tracks, darting around Bastareaud's inroads. Maxime Machenaud, meanwhile, punished Irish errors twice, making it 6-0 after 14 minutes. But Ireland were favourites for a reason: with two attacks in five minutes, the Green Devils managed to make their way into promised land (Sexton, 20m and Trimble, 25m, bringing the score to 6-12), though not without the aid of basic errors by Thomas Domingo (thrice penalised for not binding properly in the scrum, and well-replaced by Vincent Debaty after the break), and Louis Picamoles, who in a schoolboy error threw a forward pass with no-one near him. Les Bleus were rattled, but got back on the scoreboard with a fine crossfield kick from Rémi Tales, swatted in the air by Yoann Huget and finding Brice Dulin (13-12, 30m), for the 150th French try scored in the Stade de France.
Bastareaud shuts Sexton down, but the Irishman had already struck
Having been set straight by the Irish coaching staff, Jonathan Sexton's teammates sparkled once again, upending the French squad within ten minutes of the break. The fly-half for Racing 92 (whose fans will be wailing at the irony) scored his second try of the match, and fourth of the tournament, after a driving run from winger Trimble, well-offloaded by Brian O’Driscoll (13-19, 47m). The French squad seemed to lose their lucidity, sensing the shadow of a new defeat. Having conceded ten points in ten minutes, and nine points behind with 20 minutes to go, the French were gradually consumed by an Irish tide full of battle (winning 78% of scrums and 93% of lineouts), as well as well-executed mauls and the kind of pressurising kicks they alone seem to have mastered.
Bastareaud's tackle on Sexton, leaving the fly-half barely conscious, came too late. Slowly but surely the Irish held their way to victory during an drowsy final period, and celebrated in the greatest way possible the last exit of their legendary captain. We aren't compaining, especially since - even if Les Bleus were beaten - we finally saw a real match: attacks full of speed, with the forwards binding the ball carrier – this was real rugby. A shame about the result, but this team has spirit. And to boot, the English still hate us just as much.
