2.Zasądzenie od pozwanego na rzecz powoda kosztów sądowych oraz kosztów zastępstwa procesowego według norm przepisanych

1.Having issued order for payment in proceeding by writ of payment which declares that the defendant is obliged to pay the plaintiff the sum of PLN 432,978.00 (in writing: four hundred thirty-two thousand nine hundred seventy-eight PLN 0/100) augmented by statutory interest counted from 2 February 2009 until the day of payment which shall be within two weeks from service of the order for payment,

Bez względu na postanowienia niniejszych OWS lub Umowy, które stanowią inaczej, o ile wynika to z bezwzględnie obowiązujących przepisów prawa, każda Strona ponosi pełną odpowiedzialność, bez ograniczeń, za rażące zaniedbanie lub umyślne naruszenie obowiązków wynikających z OWS lub Umowy i, w takim przypadku, żadna ze Stron nie będzie zobowiązana do zwolnienia z lub przejęcia odpowiedzialności za rażące zaniedbanie lub umyślne naruszenie tych obowiązków przez drugą Stronę.
Translation - English In no case shall ABC be liable for any lost profits, indirect or consequential losses. Notwithstanding the provisions hereunder and the provisions under the Agreement, which state otherwise and if provided for in mandatory rule of law, each Party shall be fully liable, without limitation, for gross negligence or deliberate breach of obligations hereunder or under the Agreement and in such a case no Party shall be obliged to discharge from liability or to assume liability for gross negligence or deliberate breach of the obligations by the other Party.

Source text - English 1. Any notices to be served on either of the parties by the other shall be sent by prepaid recorded delivery or registered post to the address of the addressee as set out in this Agreement or to such other address as notified by either party to the other as its address for service of notices. All such notices shall be deemed to have been received within fourteen (14) days of posting.
2. Neither party’s delay or failure to perform any provision of this Agreement, as result of circumstances beyond its control (including, without limitation, war, strikes, floods, governmental restrictions, power, telecommunications or Internet failures, or damage to or destruction of any network facilities) shall be deemed to be, or to give rise to, a breach of this Agreement.
3. The invalidity or un-enforceability of any provision of this Agreement shall not affect the continuation or enforceability of the remainder of this Agreement.
4. Either party’s waiver, or failure to require performance by the other, of any provision of this Agreement will not affect its full right to require such performance at any subsequent time, or be taken or held to be a waiver of the provision itself.
5. This Agreement shall be governed by and construed in accordance with English law; subject to clause 12, the parties irrevocably agree that any dispute arising out of or in connection with this Agreement will be subject to and within the jurisdiction of the courts of England.

Wszelkie zawiadomienia dostarczane jednej stronie przez druga stronę będą dostarczane przesyłką poleconą opłaconą przez nadawcę lub listem poleconym na adres adresata podany w niniejszej Umowie albo na taki inny adres, który strona poda drugiej stronie jako swój adres do doręczeń. Wszelkie zawiadomienia będą uznawane za doręczone w terminie czternastu (14) dni od dnia nadania .
2. Opóźnienie lub niewykonanie postanowień niniejszej Umowy przez którąkolwiek ze stron w wyniku okoliczności pozostających poza kontrolą strony (w tym w szczególności wojny, strajków, powodzi, ograniczeń rządowych, awarii energetycznych, telekomunikacyjnych lub awarii Internetu, uszkodzeń lub zniszczeń urządzeń sieciowych) nie będzie postrzegane jako naruszenie niniejszej Umowy ani jako spowodowanie takiego naruszenia.
3. Nieważność lub niewykonalność któregokolwiek postanowienia niniejszej Umowy nie wpływa na ciągłość i wykonalność pozostałej części niniejszej Umowy.
4. Dobrowolne odstąpienie każdej ze stron lub niezażądanie wykonania przez drugą stronę postanowień niniejszej Umowy nie wpływa na pełne prawo tej strony do żądania takiego wykonania w późniejszym czasie ani nie jest traktowane jako odstąpienie od samego postanowienia.
5. Niniejsza Umowa podlega prawu angielskiemu i jest interpretowana zgodnie z nim; z zastrzeżeniem punktu 12, strony nieodwołalnie uzgadniają, że wszelkie spory wynikłe z niniejszej Umowy lub w związku z nią będą podlegać jurysdykcji sądów angielskich

Dysk transferowy jest niezbędny dla osób, które nie znajdują się w lokalizacji XY. Przy użyciu tego dysku można zapisywać dokumenty na serwerze Dane Globalne.
Aby przenieść plik z Danych Globalnych na lokalny serwer, musisz skopiować odpowiedni plik do folderu „transfer”.
Ten plik zostanie automatycznie zarchiwizowany na dysku transferowym i może zostać otwarty na lokalnym serwerze.
